Nil cap makes clear what is acceptable

Cllr Doody claims ‘a nil cap [on sex club licences] predetermines what we are against (Courier last week).

A nil cap safeguards the local community by making clear that the sex trade is unacceptable in certain areas. Legislation to permit such capping was introduced due to widespread public concern about the proliferation of the sex trade close to homes and in other unsuitable areas.

Case law makes clear that if it is implemented rationally, it is a legally robust mechanism which by itself provides grounds for a licence refusal

Such a clear policy against the granting of licences within, say, 500m of particular premises (including houses, schools, and places of worship) would safeguard the community, save taxpayers’ time and money, and give clarity to licence applicants and councillors alike.
